If a separate agreement applies to a chef, seller, affiliate, influencer, or contributor, that separate agreement shall apply to earnings, payouts, Mabapu Coins, content, settlement, recovery lien, and related commercial matters.

We reserve the right to refuse service, cancel orders, suspend accounts, restrict features, block payouts, or terminate access where required for legal, safety, fraud-control, compliance, or business reasons.

5. Electronic Contracting and Records

You agree that your use of this website, order placement, online payment, account registration, OTP verification, checkbox acceptance, dashboard acceptance, email confirmation, digital signature, chef contract acceptance, payout request, or continued use after notice may create a valid electronic agreement.

You agree that electronic records, order logs, payment logs, login logs, IP logs, device logs, OTP logs, contract acceptance logs, invoice records, Mabapu Coins ledger entries, payout records, audit trails, support communications, email logs, SMS logs, WhatsApp logs, and dashboard activity may be used as evidence, subject to applicable law.

No physical signature is required where acceptance is completed electronically or by conduct.

MaBapu Foods sells or facilitates the sale of authentic Rajasthani dry foods, chutneys, masalas, sun-dried specials, flours, pulses, lentils, sweets, recipe-linked products, kitchen-related products, and other marketplace products.

Product availability, prices, discounts, stock, packaging, variants, delivery timelines, and product details may change without prior notice.

We may limit quantities, refuse orders, cancel suspicious orders, restrict service to certain areas, or deny transactions that appear fraudulent, illegal, abusive, or commercially unreasonable.

Product images are for representation. Actual product appearance, color, texture, size, packaging, and batch may differ due to photography, lighting, natural ingredients, traditional preparation, packaging changes, or supplier variation.

7. Product Information

We try to keep product descriptions, ingredients, images, prices, weights, shelf life, storage instructions, allergen details, FSSAI details, GST details, and other information accurate.

However, typographical errors, pricing errors, stock errors, image errors, technical errors, or omissions may occur.

We reserve the right to correct errors, update product information, change prices, cancel orders, revise invoices, refuse fulfillment, or issue refunds if information is inaccurate or incomplete.

Customers should read product labels, ingredients, allergen warnings, expiry or best-before details, and storage instructions before use.

8. Food Safety, FSSAI, and Product Suitability

MaBapu Foods aims to comply with applicable food safety laws, food labeling requirements, hygiene standards, and quality practices.

Food products may carry FSSAI details, manufacturer details, packer details, batch number, best-before date, MRP, net quantity, vegetarian or non-vegetarian mark, allergen information, and other legal information where applicable.

FSSAI registration or license details indicate regulatory compliance where applicable. They do not mean that FSSAI personally endorses, medically certifies, or guarantees every product for every user.

Users are responsible for checking suitability before consumption, especially in cases of allergies, diabetes, blood pressure, pregnancy, infants, elderly persons, religious restrictions, medical conditions, or special diets.

Recipes, food articles, magazine content, blogs, product suggestions, cooking tips, nutrition notes, traditional food information, and health-related content on our website are provided for general information, education, inspiration, and cooking guidance only.

We do not provide medical advice, diet prescription, disease treatment, diagnosis, cure, or guaranteed health outcome.

No recipe, product, ingredient, chutney, masala, dry food, herbal ingredient, traditional preparation, or food suggestion should be treated as a replacement for medical advice.

If you have a medical condition, allergy, pregnancy, dietary restriction, or special health requirement, consult a qualified doctor, dietitian, or health professional before using any product or recipe.

10. Orders

By placing an order, you make an offer to purchase products according to these Terms, product page details, shipping policy, return policy, and payment terms.

Users may be allowed to post product reviews, recipe comments, ratings, feedback, or messages. Reviews must be honest, lawful, relevant, and based on genuine experience.

You must not post:

• fake reviews;
• paid reviews without disclosure;
• competitor attacks;
• abusive language;
• hate speech;
• obscene content;
• defamatory statements;
• medical misinformation;
• false product claims;
• personal data of others;
• spam or promotional links.

Users may review products or recipes only in the manner enabled by the Platform. If photo upload is not enabled, users must not attempt to bypass the system or send unlawful images through other channels.

We may moderate, edit, hide, reject, or remove reviews that violate law, policy, community standards, or platform integrity.

16. User Messages and Support

Users may contact us through forms, email, WhatsApp, phone, user messages, or support tools.

You must not misuse support channels for spam, abuse, threats, fraud, illegal offers, or unrelated promotion.

We may record, store, review, and use support communications for customer service, fraud prevention, legal compliance, training, audit, and dispute resolution.

17. Recipes and Content Portal

MaBapu Foods may publish recipes, cooking tips, product recommendations, video links, ingredient guides, cultural food stories, magazine content, and food articles.

Recipes may be created by MaBapu Foods, approved chefs, contributors, affiliates, editorial team, or other authorized persons.

Recipe information is for general cooking guidance only. Actual cooking results may vary due to ingredient quality, water, climate, appliance, flame level, measurement differences, skill level, altitude, cooking vessel, and personal taste.

Recipe videos may be served through third-party video links. We do not necessarily host all videos on our own servers.

18. Chef Program

MaBapu Foods may allow approved chefs to submit recipes, earn Mabapu Coins, participate in affiliate product promotion, and receive payouts according to the applicable Chef Work Agreement.

Chef participation is subject to approval, KYC, compliance checks, content review, food safety rules, contract acceptance, and platform policies.

A chef is an independent contributor and not an employee of MaBapu Foods unless expressly stated in a separate written agreement.

Chef recipes are not automatically approved or monetized. A recipe earns only if approved and activated under the applicable chef policy.

Chef earnings, Mabapu Coins, payouts, recovery liens, affiliate commissions, exit settlement, contract changes, and coin ratio changes are governed by the Chef Work Agreement and related payout policies.

19. Mabapu Coins

Mabapu Coins are internal reward units used by MaBapu Foods for approved platform activities, such as chef rewards, recipe contribution, affiliate activity, promotions, or other eligible actions.

Mabapu Coins are not legal currency, not cryptocurrency, not securities, not deposits, not stored value instruments, not bank money, not interest-bearing, and not guaranteed income.

Mabapu Coins have no independent cash value except where MaBapu Foods permits redemption or payout under applicable policy.

Coin-to-rupee conversion ratio, price-to-coin ratio, recipe view rate, affiliate earning rate, product commission rate, payout threshold, payout cycle, hold period, and redemption rules may change dynamically.

For chefs and affiliate participants, material changes to Mabapu Coin ratio or earning rules may require acceptance of a new contract or exit settlement according to the applicable Chef Work Agreement.

We may reverse, adjust, hold, expire, cancel, or forfeit Mabapu Coins created by error, fraud, fake views, returned products, refunded orders, chargebacks, affiliate abuse, policy violation, copied content, or technical bug.

20. Affiliate and Influencer Program

MaBapu Foods may offer affiliate, influencer, referral, or creator programs. Participation may require approval, KYC, agreement acceptance, tracking compliance, and policy compliance.

Affiliate earnings apply only to valid tracked sales that are completed, paid, non-cancelled, non-returned, non-refunded, non-chargeback, non-fraudulent, and outside any hold period.

No affiliate earning is payable for:

• self-orders;
• fake orders;
• bot traffic;
• coupon abuse;
• collusive orders;
• family manipulation;
• misleading advertisements;
• fake reviews;
• trademark misuse;
• spam;
• policy violation.

Affiliate rewards may be reversed if the product is returned, cancelled, refunded, disputed, charged back, or found fraudulent.

21. Marketplace and Third-Party Sellers

MaBapu Foods may operate as an inventory seller, marketplace platform, affiliate marketplace, or mixed model depending on product category and business arrangement.

Some products may be sold directly by MaBapu Foods. Some products may be listed, supplied, promoted, packed, shipped, or fulfilled by third-party sellers, vendors, chefs, suppliers, or partners.

Sellers and supplier-linked users are responsible for ensuring that their products are lawful, genuine, safe, properly labeled, not expired, not counterfeit, not adulterated, and compliant with applicable law.

We may remove products, suspend sellers, hold settlements, deduct refunds, reverse commissions, and take compliance action for unsafe, illegal, misleading, returned, defective, infringing, or non-compliant products.

22. Recovery Lien, Set-Off, and Settlement Holds

Where a chef, seller, affiliate, influencer, or contributor is responsible for product returns, refunds, chargebacks, customer complaints, wrong product, expired product, unsafe product, copied content, fake views, fake orders, fake reviews, affiliate abuse, or policy violation, MaBapu Foods may place a recovery hold, settlement reserve, lien, or set-off on payable amounts.

We may deduct, reverse, adjust, or recover amounts from current or future earnings, Mabapu Coins, payouts, commissions, affiliate rewards, redemptions, seller settlements, or settlement balances.

Recoverable amounts may include:

• refunded order amount;
• reverse logistics cost;
• payment gateway chargeback cost;
• shipping loss;
• packaging loss;
• customer compensation;
• replacement cost;
• affiliate commission reversal;
• Mabapu Coins reversal;
• tax correction;
• legal notice cost;
• dispute handling cost;
• regulatory penalty attributable to the user;
• any verified loss caused by breach or non-compliance.

Settlement may be held until return windows, refund windows, chargeback windows, complaint checks, tax checks, fraud checks, and compliance reviews are completed.

This clause does not limit any statutory consumer rights.

23. Subscription Plans

MaBapu Foods may offer free or paid subscription plans for customers, chefs, readers, businesses, or other users.

Subscription benefits, duration, price, renewal, cancellation, refund, access level, and usage limits will be shown at the time of subscription.

We may modify, suspend, or discontinue subscription plans. Already paid benefits will be handled according to applicable subscription terms and law.

Subscription misuse, account sharing, payment fraud, or policy violation may result in suspension or termination.

24. Newsletters, Magazine, and Marketing Communications

Users may subscribe to newsletters, magazine updates, recipes, offers, product alerts, chef updates, and promotional messages.

By subscribing, you consent to receive communications through email, SMS, WhatsApp, push notification, or other channels, subject to applicable law.

You may unsubscribe from marketing communications using the available unsubscribe method.

Service-related communications, such as order updates, legal notices, security alerts, policy changes, payout updates, and support responses, may still be sent where necessary.

25. Advertisements and Sponsored Content

MaBapu Foods may display advertisements, sponsored posts, sponsored recipes, product recommendations, affiliate links, banners, marketplace promotions, and paid placements.

Sponsored or affiliate content may generate revenue for MaBapu Foods or approved partners.

We aim to keep advertising lawful and not misleading, but users should independently evaluate product suitability before purchase.

Third-party ads or links may lead to external websites governed by their own terms and privacy policies.

26. Third-Party Links, Tools, and Videos

Our website may include links, embeds, payment tools, shipping tools, video links, social media widgets, analytics tools, affiliate links, maps, or other third-party services.

We do not control third-party websites or tools. Third-party services are used at your own risk and may be governed by their own terms, privacy policies, cookies, ads, and data practices.

You must not submit content that infringes copyright, trademark, privacy, publicity, confidentiality, or any third-party right.

29. Prohibited Uses

You must not scrape, crawl, copy, mass download, index, extract, train AI systems on, reproduce, or commercially use our product data, recipes, content, prices, images, reviews, or database without written permission.

You must not use bots, automated scripts, fake traffic, click farms, data extraction tools, or AI agents to manipulate views, reviews, orders, affiliate commissions, coins, rankings, or analytics.

We may block IP addresses, accounts, devices, traffic sources, bots, or suspicious activity.

31. Compliance Invoices and Financial Ledger

Orders, refunds, taxes, payouts, commissions, seller settlements, affiliate rewards, Mabapu Coins, redemptions, recovery liens, and deductions may be recorded in our financial ledger and compliance systems.

Invoices, credit notes, debit notes, payout statements, ledger records, tax records, and compliance documents may be generated according to applicable law and Company settings.

Users, chefs, sellers, and affiliates are responsible for reviewing their invoices, settlement statements, and tax records and reporting discrepancies within the time specified by Company policy.

32. Forensic Audit Trail

MaBapu Foods may maintain forensic audit trails for security, legal compliance, fraud prevention, financial accuracy, consumer protection, and dispute resolution.

Audit trails may include login records, IP address, device details, acceptance logs, OTP records, order history, payment logs, refund logs, payout logs, ledger entries, product changes, recipe changes, admin actions, user messages, and notification records.

Audit records may be used to verify orders, claims, returns, reviews, coin earnings, affiliate tracking, chef acceptance, contract changes, settlement, fraud, and legal disputes.

33. Privacy and Personal Data

Your submission of personal information is governed by our Privacy Policy.

We may collect and process personal data such as name, email, phone number, address, payment details, order history, account data, support messages, cookies, device data, IP address, reviews, preferences, chef KYC, seller details, and payout details.

To the maximum extent permitted by law, MaBapu Foods shall not be liable for indirect, incidental, special, punitive, consequential, business, reputational, loss of profit, loss of opportunity, loss of data, loss of goodwill, or loss of expected earnings.

Our liability for any order shall not exceed the amount paid by you for that specific order, except where law requires otherwise.

For chefs, affiliates, sellers, influencers, or contributors, liability and earning disputes shall be governed by the applicable contract and payout policy.

40. Indemnification

You agree to indemnify, defend, and hold harmless MaBapu Foods, its directors, officers, employees, partners, vendors, affiliates, agents, contractors, service providers, suppliers, and representatives from claims, losses, damages, costs, penalties, legal fees, or demands arising from:

• your breach of these Terms;
• your misuse of the website;
• your illegal activity;
• your content;
• your reviews;
• your fake claims;
• your payment fraud;
• your violation of law;
• your infringement of third-party rights;
• your product, recipe, affiliate, seller, or chef activity;
• your misuse of customer data;
• your harmful or misleading conduct.

41. Termination

These Terms remain effective unless terminated by you or us. You may stop using the website at any time.

We may suspend or terminate your account, orders, chef access, affiliate access, seller access, reviews, coins, payouts, or other services if you violate these Terms, break law, misuse the platform, commit fraud, or create risk for customers or the Company.

Termination does not affect pending payment obligations, refund rights, recovery liens, taxes, indemnity, confidentiality, intellectual property rights, audit records, or legal claims.

42. Changes to These Terms

We may update, change, or replace these Terms at any time by posting the updated version on our website.

Material changes may also be notified through dashboard, email, SMS, WhatsApp, website notice, or other reasonable method.

For chefs, affiliate participants, or earning users, material changes to coin ratio, payout value, or earning rules may be governed by the applicable Chef Work Agreement or Affiliate Agreement.

43. Force Majeure

We shall not be responsible for delay, failure, or non-performance caused by events beyond our reasonable control, including natural disaster, fire, flood, epidemic, pandemic, war, riot, strike, government order, court order, regulatory action, internet failure, cyberattack, payment gateway failure, bank failure, courier failure, power failure, cloud outage, or third-party service failure.

44. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted according to the laws of India.

Users should first contact us at info@mabapu.com or compliance@mabapu.com for dispute resolution. We will attempt to resolve genuine complaints in good faith.

Subject to applicable consumer rights and statutory remedies, disputes shall be subject to the jurisdiction of courts at Churu, Rajasthan, India.

For chefs, affiliates, sellers, or contributors with separate contracts, arbitration or dispute resolution terms in the relevant agreement may apply.

45. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted by law.

The remaining provisions shall continue in full force.

46. No Waiver

Failure by MaBapu Foods to enforce any right or provision shall not be treated as a waiver of that right.

We may enforce any right later, partially, or fully.

47. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Return and Refund Policy, Shipping and Delivery Policy, Chef Work Agreement, Affiliate Terms, Subscription Terms, Product Review Policy, and other applicable policies, constitute the complete agreement between you and MaBapu Foods regarding your use of the website and services.
